This week Demand Media, parent company of eNom, announced it
was investing $18 million in new top level domains.

The company declined to specify if that was just for application
fees or included infrastructure, marketing, etc.

But from the way company representatives described it on the
investor conference call, it sounds like much of the $18M is
for application fees. It said it "funded" the $18 million
in April.

When pressed what that means, the company reiterated that the
money was invested in April, again making me think much of it
was for applications. (April was supposed to be the deadline
for applying.)

At $185,000 a pop, that means Demand could be looking at close
to 100 top level domains.

That's a serious commitment and might make Demand Media the
biggest applicant.

On the flip side, Go Daddy told me yesterday that it has applied
for only 3 top level domains.

It's worth noting that the spirit of the new TLD guidebook
seems to forbid Demand Media from applying at all.

It states:

"In the absence of exceptional circumstances, applications
from any entity with or including any individual with
convictions or decisions of the types listed in (a) – (m)
below will be automatically disqualified from the program."

and here's item M from the list:

"m. has been involved in a pattern of adverse, final decisions
indicating that the applicant or individual named in the
application was engaged in cybersquatting as defined in
the Uniform Domain Name Dispute Resolution Policy (UDRP),
the Anti-Cybersquatting Consumer Protection Act (ACPA), or
other equivalent legislation, or was engaged in reverse
domain name hijacking under the UDRP or bad faith or
reckless disregard under the ACPA or other equivalent
legislation. Three or more such decisions with one occurring
in the last four years will generally be considered to
constitute a pattern."

Demand would be disqualified based on losses from its Demand
Domains company.

But the way this is written, there are plenty of loopholes
that should allow Demand to play the game.
