ICANN has opened its application system for new top level
domains. It isn't releasing much in the way of statistics yet,
other than saying that 25 groups have registered for the
application system as of last week. (Each registered user can
apply for multiple TLDs.)
One TLD story I've been following closely is so-called "trademark
frontrunning". It refers to the dozens of trademark
applications filed for possible future top level
domains, such as .photo or .secure.
I've been under the impression that the US Patent and Trademark
Office wasn't doing a good job catching these applications.
But after reviewing 115 of them, I can comfortably say that it is
on top of things.
It has denied many of these applications, and almost uniformly
is sending office actions to applicants saying they won't
issue a trademark on a TLD. Not trademarking a TLD has been its
policy since 2005.
One applicant alone is listed on at least 27 applications,
ranging from .move to .mail. The USPTO has sent him an office
action on each domain informing him it won't approve a TLD
as a trademark.

So what's the big deal? If someone gets a trademark, they'll
likely use it to either scare away competition or sue legitimate
TLD applicants.
The U.S. seems to have this mostly under control, but other
countries are issuing TLD-related trademarks. I think this is one
of the ticking time bombs of the new TLD program. Even though
ICANN won't consider any such trademarks in the application
process, it will reverberate during the process.
